These terms cover the use of getemberorigin.com and the services provided by Ember Origin. By working with us or using this site, you agree to what is written here.

SMS messaging program terms

Program: Ember Origin sends one-to-one text messages to business owners who have verbally agreed, on a phone call with us, to receive them.
Message frequency varies and is low — typically a single message following a call, and occasional follow-up.
Message and data rates may apply.

How you opt in

Consent is given verbally during a phone call that Ember Origin places to your business. On that call we ask whether we may text you at the number we are speaking to — usually to send a link to a website we have built or discussed — and we send a message only if you say yes. We do not buy or rent phone numbers, and there is no web form or checkbox that opts anyone in to SMS.

How you opt out

Reply STOP to any message and you will be unsubscribed immediately. You will receive one confirmation message and then nothing further. You may also opt out by telling us on a call or by emailing us. Opting out costs you nothing and affects nothing else.

Carriers

Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to carrier and device conditions outside our control.

Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for the full statement.

Calls

We place business-to-business calls to trades businesses about website services. If a call is being recorded we say so at the start of the call. Tell us to stop calling and we will, and the number goes on our internal do-not-call list.

Our services

Ember Origin designs, builds, hosts and maintains websites for trades businesses. The specific scope, price and timeline of any engagement are what we agree with you in writing before work starts. Nothing on this website is itself an offer or a contract.

What we need from you

To build your site we need accurate information about your business — licence details, service area, photographs and similar. You confirm you have the right to give us anything you send, and that it is accurate. We are not responsible for claims made about your business that you asked us to publish.

Payment and billing cycle

Care plans are billed every four weeks, not monthly. Four-weekly billing means 13 billing periods in a year, not 12. We state this plainly here and we will say it out loud before you agree to anything, because a billing cycle nobody explained is not a deal, it is a complaint waiting to happen.

Your price, start date and what is included are set out in the agreement for your engagement. Plans continue until you cancel. You may cancel with notice as set out in that agreement; we do not lock anyone into a term they did not agree to, and we do not charge a penalty for leaving.

If you would rather not use an online payment link, we will take your card or bank details on a call or screen-share and enter them into our payment processor with you. We never write your card number down or keep it. See our Privacy Policy.

What you own, and what you are licensed to use

Your content stays yours. Your business name, logo, photographs, reviews, copy you wrote and anything else you give us belongs to you, during the engagement and after it. Cancel at any time and we will hand it all back.

The website itself, and the systems behind it, remain the property of Ember Origin. A care plan is a licence to use them, not a purchase. While your plan is active you have the full use of the site, the hosting, the updates and the support. When the plan ends, the licence ends and the site goes offline. We say this here, in writing, and we say it on the call, because nobody should discover it later.

Buyout. If you want to own the website outright and host it yourself, you can buy it. The buyout price is stated in your agreement and is payable once; after it, the website files are yours to take anywhere and we will help you move them.

What a buyout does not include. The automation systems — missed-call text-back, review requests, lead routing, the CRM and anything else built on our platform — are built inside software we license and operate. They are not part of the website and cannot be transferred or exported. If you leave, the website can come with you; the automations stop. We would rather you knew that on day one than on your last day.

Acceptable use

Do not use our services to publish anything unlawful, deceptive or infringing, or to hold yourself out as licensed or insured when you are not.

Availability and liability

We aim to keep the sites we host online and working, but we do not guarantee uninterrupted service, and we rely on third-party hosting and infrastructure. We do not guarantee any particular ranking, traffic volume or number of leads. To the fullest extent the law allows, our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.

Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed. Material changes to a live engagement will be told to you directly, not buried here.

Governing law

Ember Origin is a sole proprietorship operated from India, serving clients in the United States and Canada. Nothing in these terms removes any right you have under the consumer or telecommunications law of your own country or state.
